FYI: Guidelines for Obtaining a New York State Roofing Contractor's License

Obtaining a roofing license in the state of New York requires a few specific steps but allows contractors to provide a variety of services within the context of home repairs, not just repairing or replacing roofs. A home is one of, if not the most important investment, that a person will make in their lifetime, so regular, quality maintenance is essential. Choosing a reputable roofer is an important process and the license is the first place to start.

Anyone operating a business that engages in the construction, repair, remodeling or addition to any piece of property used as a residence must possess a Home Improvement Contractor license. This includes any construction - remodeling a basement, resurfacing a driveway, replacing a fence building on a garage, any type of major landscaping, adding porches or patios, swimming pools, and any other improvement or structure that is attached or adjacent to a home or residence.

A contractor may not begin any type of work until he actually possesses a valid, active Home Improvement license. To obtain this license, one must do several things. Before beginning the process, several documents must be produced.

First, an applicable business certificate based on the legal structure of the business must be filed with the clerk of the county in which the business is conducted. Sole proprietorships (DBA - doing business as) do not need a business certificate, while those operating under a name other than their own must file a business/assumed name certificate. Corporations, partnerships, limited liability companies or limited liability partnerships must register and remain active with the New York State Department.

Once this has been completed, a sales tax ID number and proof of business address must also be supplied. A $75 processing fee is paid as well. Contractors owning at least 10% of the business must be fingerprinted and provide proof of workman's compensation insurance. You have the option of enrolling in the Trust Fund Surety Bond or providing your own proof of $20,000 surety bond ownership.

All applicants who wish to become contractors, even if just for the purpose of roofing, must pass the Home Improvement Contractor Exam, provided through the state of New York. The exam consists of thirty questions and the test taker must answer at least twenty one correctly in order to pass the exam.
